President Joe Biden said Saturday that the Department of Justice would appeal a federal judge in Texas’ ruling that said that the Deferred Action for Childhood Arrivals program (DACA) was illegal, according to NBC News.
Biden said U.S. District Court Judge Andrew Hanen’s decision was “deeply disappointing” and that striking down DACA “relegates hundreds of thousands of young immigrants to an uncertain future.”
Under the Obama-era program, recipients, also known as “Dreamers,” were allowed to stay in the United States after being brought into the country illegally as a child. DACA has allowed almost 800,000 people to stay in the country and avoid deportation.

Hanen said President Barack Obama’s administration didn’t follow federal administrative rules when creating DACA in 2012, NBC News reported. Nine states, including Texas, sued the Obama administration, saying it went around Congress to make DACA.
He also said the Department of Homeland Security cannot accept new applications from people trying to gain entry to DACA but that those in the program can remain.
“It is not equitable for a government program that has engendered such significant reliance to terminate suddenly,” Hanen said.
Biden has asked Congress to come up with a bill that will permanently protect DACA recipients, saying, “only Congress can ensure a permanent solution by granting a path to citizenship for Dreamers that will provide the certainty and stability that these young people need and deserve.”
