A Black man in suing the Los Angeles Police Department for violating his civil rights by racially profiling and wrongfully arresting him in an incident in May 2019.
According to a CNN report, Antone Austin, a music producer, was mistaken for a man violating a restraining order. The report said that officers were responding to a call from a woman regarding her ex-boyfriend and a restraining order violation.
“She had given no description of the suspect, which did not deter officers from pursuing Austin,” according to the complaint filed in federal court.
During the altercation, Austin’s girlfriend Michelle Michlewicz was also taken into custody when she attempted to intervene with the arrest. Austin’s neighbor Katarina Richardson, the person who originally called the police, told officers that Austin was not the perpetrator according to the complaint.
The claim also stated that during Richardson’s call, she was not asked to give a description.
In a report from KABC Austin stated, “I was the first Black dude he saw and it’s weird, they weren’t even looking for a guy that looks like me,” he went add that the person they were looking for was a shorter person and bald.
Austin was initially charged with resisting arrest and battery on a peace officer, which was eventually dropped to resisting arrest with a $7,000 bond, according to Jasmyne Cannick, a media representative for the couple.
Michlewicz, a singer, was charged with felony lynching with a bond of $50,000.
The couple has not been formally charged or had their charges dismissed. They also have not had their bond money returned.
