Albany’s district attorney announced on Tuesday he’s dropping the criminal case against former Gov. Andrew Cuomo, citing a lack of evidence.
“While we found the complainant in this case cooperative and credible, after review of all the available evidence, we have concluded that we cannot meet our burden at trial,” Albany County District Attorney David Soares said in a statement, the Associated Press reported.
Cuomo was accused of groping an aide and was days away from answering questions about the charge in court. While the criminal misdemeanor charge was dropped, a civil case against Cuomo is still on the table, according to NBC New York.
The woman, Brittany Commisso, was one of the former governor’s executive assistants.
According to a report by New York Attorney General Letitia James, Commisso accused Cuomo of sliding his hand up her blouse and grabbing her breasts in the governor’s mansion in 2020.
Cuomo resigned from office in August following an investigation into allegations that he sexually harassed dozens of women, including staffers.
