Damian Daniels’ Family React to No Indictment for Deputy That Killed Him

The veteran was shot and killed on Aug. 25, 2020 by Deputy John Rodriguez during a mental health crisis.

On Dec. 20, a Bexar County, Texas grand jury made the decision to not indict Deputy John Rodriguez who shot and killed veteran Damian Daniels during a mental health crisis on Aug. 25, 2020, according to News 4 San Antonio

The incident happened outside of Daniels’ home in the 1100 block of Liberty Field as he was dealing with a death in the family. The shooting has led to criticism by Bexar County Judge Nelson Wolff, as it led to a new program that is designed to respond to mental health situations.

This case was brought to a grand jury by the Bexar County District Attorney’s Civil Rights Division. After a review of all of the evidence, the jury issued a “no bill of indictment” and Rodriguez was cleared of wrongdoing. 

“The death of Mr. Daniels was tragic. This country needs to do a better job of helping those in mental health crisis. We have reviewed the video with the Daniels family and have informed them of the Grand Jury’s decision. As I have stated in the past, every officer-involved shooting in Bexar County resulting in serious injury or death will be decided by a Grand Jury,” Bexar County District Attorney Joe Gonzales said in a statement

The body cam footage was released highlighting the entire situation until the fatal shots. 

“He never moved or said anything for you to attack him like that,” Daniels’ mother Annette Watkins said to News 2 San Antonio.  

“The grand jury process needs to have a different approach because they failed our family,” said Brendan Daniels, Daniels’ brother. “They failed a veteran, they failed the City Of San Antonio and they also failed the United States.”
