According to CNN, the lawsuit was filed on October 18 and alleged negligence by the companies that own and run Arden Villas Luxury Apartments in Orlando, Florida. Arden Villas Apartments LLC owns and operates the complex while The Preiss Company manages it.
Marcano both lived and worked there. The 19-year-old went missing and was last seen at the apartment complex on September 24. Armando Caballero, a 27-year-old maintenance worker for the facility, was the main suspect in Marcano’s disappearance.

Police later found his body in his apartment, where he died by suicide. Marcano’s body was then found in a wooded area near the apartment on October 2.
Caballero’s estate is also listed as a defendant in the lawsuit as Orange County Sheriff John Mina said investigators believe “pretty conclusively” Caballero is “responsible” for Marcano’s death, CNN reported.
Authorities believe he entered Marcano’s apartment without her permission. “We now know that a maintenance-issued mater key fob, which Caballero was known to be in possession of, was used to enter Miya’s apartment Friday afternoon, at about 4:30. This would have been about 30 minutes before she should finish her shift at the apartment complex,” Mina said.

The lawsuit asserts Caballero, who was believed to be interested in the 19-year-old, made Marcano uncomfortable. It says, “Marcano expressed her concerns to employees of the Arden Villas as well as to her parents who were concerned that …the manager of Arden Villas was not taking the safety concerns of the employees and tenants, very seriously.”
The Marcano family attorney Daryl K. Washington said the apartment complex needs to take accountability for the young woman’s death. “Arden Villas gave Armando Caballero the unfettered access he needed to kill Miya. They need to be held accountable for their negligence.”

The lawsuit is seeking $30,000 in damages and demands a jury trial.
