Judge, Prosecutor Argue During Kyle Rittenhouse Trial

There was more action recently in the Kenosha County Courthouse in the trial of Kyle Rittenhouse. Kenosha County Judge Bruce Schroeder called out Assistant District Attorney Thomas Binger, who is a prosecutor, by accusing him of a “grave constitutional violation” while cross-examining the 18-year-old, according to INSIDER

Binger started his questioning aimed at Rittenhouse, who decided to stay silent after the deadly shooting that occurred in Kenosha, Wisconsin, in August 2020. Rittenhouse’s attorney Mike Richards objected, which led to Judge Schroeder putting a halt to the trial. Schroeder sent the jury out of the room and said to Binger that he was close to crossing the line, according to INSIDER. 

“I was astonished when you began your examination by commenting on the defendant’s post-arrest silence. That’s basic law. It’s been basic law in this country for 40 years, 50 years. I have no idea why you would do something like that,” he said

Schroeder additionally blasted Binger for talking about a piece of evidence the judge had forbidden to be brought up in the trial, according to INSIDER. 

Binger was referring to a video that was recorded weeks before the Kenosha shooting in which Rittenhouse stated he wished he had his AR-15 to shoot people leaving a CVS store. 

Richards described the situation as “ridiculous” and said the prosecutor was disregarding the judge’s rulings, according to INSIDER.

Schroeder blasted Binger when he said that Rittenhouse’s testimony would open the door to more questions. 

“Don’t get brazen with me,” he said. “I don’t want to have another issue as long as this case continues. Is that clear?”
