The group is alleging mistreatment by U.S. immigration authorities. One of the plaintiffs, Mirard Joseph, was seen in a viral photo of a Border Patrol agent on a horse grabbing him by the collar, ABC News reported. Joseph said the moment was “the most humiliating experience of his life.” He also said the border patrol agent “lashed at him” with his reins and tried dragging him.

Joseph’s story highlights the fight many Black and Brown refugees have in their pursuit of the American dream. He was crossing the river from Mexico in an attempt to bring food to his family. After being sent back to Haiti, he said he is waiting for another chance to seek asylum in the U.S.
The lawsuit alleges an agent attempted to drag him back into the water. It also said the Biden administration avoided providing humanitarian aid to the area to deter migrants from crossing.
The lawsuit also includes personal testimony from several other migrants who alleged agents beat migrants, shoved them back in the river, and cut a rope they were using to get out of the river as they struggled to keep their heads above water, according to ABC News.

Advocacy Groups Justice Action Center, Haitian Bridge Alliance and Innovation Law Lab are representing the group of migrants. The plaintiffs want the U.S. government to help them return to the country, give them an opportunity to apply for asylum and money to cover their expenses.
“We must hold the Biden administration accountable for the unconscionable civil rights abuses that occurred in Del Rio, Texas,” Kevin Tumlin, the founder of the Justice Action Center, said. “The United States government at the highest level knew of a potential influx of asylum seekers in the United States and they chose to not even do the bare minimum to prepare.”

The treatment of migrants at the border caused outrage in September after videos and photos showed agents on horseback chasing the migrants as they sought refuge. Thousands of migrants traveled to Mexico to cross into the U.S to seek shelter after Haiti experienced the assassination of its president, followed by a deadly earthquake.
Biden and Homeland Security Secretary Alejandro Mayorkas are named as the defendants in the lawsuit. After the backlash, horse patrols at the border were temporarily suspended and the agents involved in the abuses against migrants were questioned.
