“This decision as it stands will have far-reaching negative consequences beyond Montgomery County and Pennsylvania. The U.S. Supreme Court can right what we believe is a grievous wrong,” Montgomery County District Attorney Kevin Steele wrote in the petition.

Cosby was convicted in 2018 to three to 10 years in prison for drugging and assaulting Temple University administrator Andrea Constand at his Philadelphia home in 2004. He spent nearly three years in prison.
In June, Pennsylvania’s Supreme Court overturned Cosby’s conviction, saying that Steele, who tried the case, was bound by his predecessor’s agreement with the comedian in Constand’s civil case against him.
In 2005, then-prosecutor Bruce Castor announced in a press release that his office did not have enough evidence to arrest Cosby. However, days before the statute of limitation expired, Cosby was arrested and charged in 2015.
Steele wants the U.S.’ highest court to review the case under the U.S. Constitution’s due process clause, AP reported.
