Rittenhouse Lawyers Ask For Mistrial as Jury Deliberations Continue

For the second time during the course of the trial for Kyle Rittenhouse, the teen's defense lawyers have asked for a mistrial.  

Defense attorneys representing 18-year-old Kyle Rittenhouse in his trial asked the judge to declare a mistrial on Wednesday.  

According to The Guardian, his attorneys say they did not receive essential drone video in the same quality the prosecution presented. Defense attorney Corey Chirafisi said his team initially received a compressed version of drone video prosecutors played during their closing arguments.

Prosecutors used the video in an attempt to debunk the teen’s self-defense claims. The video allegedly showed Rittenhouse pointing his gun at protesters before being chased by Joseph Rosenbaum, one of the men Rittenhouse is on trial for shooting and killing, during protests after the shooting of Jacob Blake in Kenosha, Wisconsin.

“The idea that the state would provide lesser quality footage and then use that footage as a linchpin in their case and it is the very reason they requested and were granted the provocation instruction by the court,” the motion read. “The failure to provide the same quality footage in this particular case is intentional and clearly prejudices the defendant.”  

The request for a mistrial came on day two of jury deliberations in the case. This is the second request by the defense for a mistrial. The first came on Nov. 10 when Chirafisi cited prejudice.

Assistant District Attorney Joseph Binger and Judge Bruce Schroeder argued several times in court last week when the jury was not present. The first argument was related to Rittenhouse not speaking after being arrested, which is his right. Schroeder issued a warning to the prosecution, but a second incident ensued when Binger asked Rittenhouse about an incident that took place two weeks after the trial ended when Rittenhouse was seen at a bar in a shirt that said: “Free As F—.” Schroeder previously ruled that evidence would not be allowed in court.

Rittenhouse, who was 17 at the time, is accused of crossing state lines, shooting Gaige Grosskreutz and killing Anthony Huber and Rosenbaum in August 2020. He pleaded not guilty to six charges, including first-degree reckless homicide, first-degree recklessly endangering safety, first-degree intentional homicide, attempted first-degree intentional homicide, and first-degree recklessly endangering safety. Schroeder dismissed the misdemeanor weapons charge against Rittenhouse, BNC previously reported.
