Rayshard Brooks’ Family Files Lawsuit Against Atlanta Police

Tomika Miller, the widow of Rayshard Brooks, wants to hold Atlanta police accountable with a new lawsuit filed against them.

Tomika Miller is looking for justice after Atlanta police shot the 27-year-old Black man mercilessly in a Wendy’s parking lot on June 12, 2020. So, she is suing the City of Atlanta and the two police officers who had a hand in killing Rayshard Brooks.  

According to TMZ, the lawsuit was filed by Miller on behalf of the Brooks’ estate and she said the incident that resulted in her husband’s death was “senseless and unjustified.”  

The 41-minute altercation began with Brooks being “calm, polite, cordial and cooperative” according to Miller’s lawsuit. The situation became intense after officer Garrett Rolfe put handcuffs on Brooks and threw him on the ground.  

Next, the lawsuit alleges that officer Devin Brosnan threatened Brooks with a taser, although Brosnan had not yet been qualified to use the taser through the mandatory taser certification course. However, Brooks was able to stand and got control of Brosnan’s taser, which was the moment when Rolfe hit Brooks with taser darts.  

After being tased, Brooks attempted to run from the cops. Officer Rolfe fired three bullets from his weapon but only two hit Brooks in the back, which sent Brooks to the ground, says Miller. Brooks wasn’t given any medical attention after cops shot him and instead Rolfe decided to kick Brooks.  

Miller’s lawsuit alleges that officer Rolfe behaved with malice and an intent to injure Brooks by using deadly and excessive force. The officers are both guilty of not giving Brooks medical aid after shooting him.  

Miller also blames the City of Atlanta in her lawsuit for not adequately training and supervising its officers. Miller is seeking unspecified damages from all of the parties involved.
